What is the Difference Between a Notary and an Attorney?

There can be confusion about what notaries or “notarios” can do legally in the US compared to other countries. In Mexico and other places, a notary is like a lawyer. They went to law school and can help with legal problems.

In the US, notaries are different. Getting the title “notary” here means you can witness people signing documents and saying they are true. But notaries are not lawyers - did not go to law school, cannot practice law and should not draft documents. They can not give legal advice or speak for you in court. Only an attorney/lawyer who passed the bar exam can do those things and help solve your legal issues.

So if you have a legal problem or question in the US, look for an attorney/lawyer. Notaries might witness your documents. But they can’t act as your legal representative and should not be drafting legal documents. Be careful relying on notaries, thinking they are like lawyers. Make sure you speak to an attorney licensed in your state if you need real legal help.
